Changes for Social Security Disability Cancer Listing?

| Feb 7, 2014 | Social Security Disability Insurance (SSDI) |

The Social Security Administration has proposed changes that would affect people seeking Social Security Disability or SSI benefits for cancers.  The SSA is seeking changes to the Malignant Neoplastic Diseases Listings of Impairments. The listing was last changed in 2009. The proposed changes are:

  • Change the body system from “Malignant Neoplastic Diseases” to “Cancer.”
  • How cancer is evaluated when treated with multimodal antineoplastic therapy under certain listings. Adjudication could be deferred in if the treating source plans multimodal therapy but has not yet initiated it.
  • Changes to definition of certain terms including “antineoplastic therapy,” “unresectable,” “persistent,” and “progressive.”
  • How some specific cancers are evaluated, e.g., chronic leukemia, primary breast cancer (including secondary lymphedema), central nervous system cancers, primary peritoneal cancer, recurrent prostate cancer, and malignant melanoma.
  • Evaluation of cancers treated with bone marrow or stem cell transplantation.
