Social Security Disability or SSI for Cerebral Palsy

Individuals may qualify for Social Security Disability or SSI benefits on the basis of cerebral palsy. The Social Security Administration recognizes the devastating and debilitating effects of cerebral palsy. If the cerebral palsy is severe enough and well documented, the Social Security Administration may approve a claim without even considering one’s ability to perform past work or other work in the economy. The requirements are set out in section 11 of the Listings. To qualify for benefits under Listing 11.07, one must show:

  • an IQ of 70 or less; or
  • abnormal behavior patterns, such as destructiveness or emotional instability; or
  • significant interference in communication due to speech, hearing, or visual defect; or
  • significant and persistent disorganization of motor function in two extremities, resulting in sustained disturbance of gross and dexterous movements, or gait and station.

If a claimant does not qualify for benefits based on this Listing, the impairments can still be considered when determining whether he can return to past employment or whether jobs exist in the local and national economy with the claimant’s residual functional capacity.
